Sell Land for Development

In short

Selling land for development in the UK means agreeing a deal with a developer who can see new homes on your site, whether that is a field, a paddock, a large garden or a former commercial yard. Land to Homes can buy suitable land outright, or partner with you through an option or promotion agreement so the land sells once planning permission is in place.

Sell Land for Development: how it works

Most landowners sell development land once in their lives, so it pays to understand the routes before anyone talks numbers. There are three: sell the land as it is, sell it once someone has secured planning permission, or keep a share of the upside through a joint venture. Land to Homes works all three. We look at the site, the local planning policy and the access, tell you plainly which route we think fits and why, and then either make a direct offer or set out option or promotion terms. On option and promotion agreements we fund the planning work and pay your reasonable legal fees, agreed in the heads of terms before anything is signed. If your land is better suited to someone else, we will say so.

Who is this for?

  • You own a field, paddock or large garden next to existing homes
  • You have been approached by a developer and want a second view
  • You want a clean sale now rather than waiting years for planning
  • You are happy to wait if planning could multiply the value
  • You are selling on behalf of a family, trust or estate
  • You own a former commercial or yard site that has stopped earning

What you get with Land to Homes

Three ways to sell

A direct purchase, an option agreement or a promotion agreement. We explain the trade-off between certainty now and value later, in writing, so you can compare like with like.

Free site appraisal

A no-obligation desktop appraisal covering access, planning policy, likely constraints and an indicative number of homes, before you spend a penny on advice.

Your legal fees covered

On option and promotion agreements we pay your reasonable legal fees. The figure is agreed up front in the heads of terms, so there are no surprises later.

Nothing to pay upfront

Where we promote land through planning, we fund the planning work. They are only recovered from the sale proceeds if the land sells with permission.

Direct purchase on suitable sites

Where a site suits us, we can buy it ourselves with or without planning, with no onward chain, subject to survey, title and contract.

Straight answers on value

We explain how development land is valued, including the costs a buyer has to allow for, so you understand an offer rather than just receiving one.

We build what we buy

Land to Homes is part of the S&K Group, a construction and property group, so we plan sites around homes we can actually build and deliver.

Every nation covered

We work across England, Wales, Scotland and Northern Ireland and tailor each deal to the planning and conveyancing rules that apply where your land sits.

What happens next

  1. Tell us about the land

Send a postcode or a rough plan. A few details about access, size and current use are enough to start.

  2. Free appraisal

We review planning policy, constraints and access, then call you to talk through what the site could take and the routes open to you.

  3. Heads of terms

If it stacks up, we set out an offer or option or promotion terms in writing, including how your legal fees are covered.

  4. Contracts and completion

Your solicitor and ours agree contracts. On a direct sale we complete; on an option or promotion we start the planning work under the agreed terms.

How it differs across the UK

ENGEngland

In England, planning decisions follow the National Planning Policy Framework and the council's Local Plan. Where a council cannot show enough land for housing, sites on the edge of settlements can come forward sooner, which affects whether we buy now or promote.

WLSWales

In Wales, sites are judged against Planning Policy Wales and the council's Local Development Plan. Most new developments also need sustainable drainage approval from the local SuDS approving body, which we build into our appraisal from day one.

SCTScotland

In Scotland, land sales are concluded through missives rather than exchange of contracts, and planning follows National Planning Framework 4 and the Local Development Plan. Where permission is needed, a deal can be made conditional on planning permission in principle.

NIRNorthern Ireland

In Northern Ireland, the 11 district councils decide most planning applications under the Strategic Planning Policy Statement and their local development plans. Countryside policy is tight, so land within or next to settlement limits is the strongest starting point.

Frequently asked questions

Can I sell land for development without planning permission?

Yes. Many sites change hands without planning. A buyer will either pay a price that reflects the planning risk, or agree a deal where the final price is set once permission is granted. We can do either, and we will explain which gives you the better outcome for your land.

How much is my land worth for development?

It depends on how many homes the site could take, what those homes would sell for locally, and the costs of building them, including roads, drainage, affordable housing and planning obligations. Agricultural or paddock land without planning prospects is worth far less than land with permission. Our free appraisal explains the factors for your site.

Who pays the legal fees when I sell land?

On a straightforward sale each side normally pays its own. On option and promotion agreements with Land to Homes we pay your reasonable legal fees, and the amount is agreed in the heads of terms before you instruct a solicitor.

What size of land do you buy?

From single infill plots that could take one or two homes up to fields large enough for a full development. If a site is too small or too constrained for us, we will tell you quickly rather than leave you waiting.

Do I need an agent to sell development land?

You do not have to use one, but independent advice is sensible on any land deal. Many landowners use a land agent or chartered surveyor, and you will need your own solicitor. Where we agree to cover your reasonable legal fees, the cap is set out in writing.

How long does selling land for development take?

A direct sale of land with clear title can move as quickly as the legal work allows. Where planning permission is needed first, the timescale depends on the local plan and the planning process, which is why options and promotion agreements run over a set term.

What makes land suitable for new homes?

Good road access, a position next to or within an existing settlement, no overriding constraints such as high flood risk, and local planning policy that supports new housing. Sites that miss one of these can still work, but the route and timescale change.

Will I have to pay tax when I sell land?

Selling land can create a Capital Gains Tax or Income Tax liability depending on your circumstances. We are not tax advisers, so we always recommend speaking to an accountant before you agree terms. GOV.UK has a guide to tax when you sell land and property.
