Planning and land rules in Winchester
In England, most planning applications for new homes in Winchester are decided by the local planning authority, usually the council, using its Local Plan and the National Planning Policy Framework. Many landowners sell without planning, either outright or through an option or promotion agreement that funds the application first. Land to Homes offers a free site appraisal, pays your reasonable legal fees on option and promotion agreements, and can buy suitable sites directly, subject to survey, title and contract.
Buying a new-build home in Winchester follows the usual English process: an offer, conveyancing, exchange of contracts, which makes the purchase binding, and completion. Many buyers arrange a snagging inspection to find defects. New homes are usually covered by a structural warranty, and developers registered under the New Homes Quality Code give buyers access to the New Homes Ombudsman Service. We have no homes on sale yet, so register your interest to hear about future homes.
| Local planning document | Local Plan |
|---|---|
| In-principle consent | Outline planning permission, with reserved matters approved later |
| Land registration | HM Land Registry |
| How a sale becomes binding | A land sale becomes legally binding on exchange of contracts and finishes on completion, after which the buyer registers the title with HM Land Registry. |
| Developer contributions | Section 106 planning obligations, plus the Community Infrastructure Levy (CIL) where the council charges it |
Land and homes in Winchester: questions
Do you have any new homes for sale or rent?
Not yet. Land to Homes is a new venture and has no homes, plots or developments for sale or rent at the moment. You can register interest with the area and type of home you want, and we will contact you if we bring forward homes that match. We do not take reservations, fees or deposits at this stage.
What is an option agreement?
An option agreement gives a developer the right, but not the obligation, to buy land within an agreed period, usually once planning permission is granted. The landowner normally receives an option fee, and the purchase price is worked out under an agreed formula. On option agreements with Land to Homes, we pay your reasonable legal fees, agreed up front in the heads of terms.
Who decides who gets an affordable or social home?
Councils and housing associations, not developers. They set eligibility, usually based on income, housing need and sometimes a local connection, and allocate homes through their own lists or sales processes. In Northern Ireland, social homes are allocated through the Northern Ireland Housing Executive's common waiting list. Land to Homes does not allocate homes.
What is a land promotion agreement?
Under a promotion agreement, a promoter funds and manages the planning process, then markets the land for sale with the landowner once permission is granted. The proceeds are shared under an agreed formula after the promoter's costs. With Land to Homes there is nothing to pay upfront: planning costs are only recovered from the sale proceeds if the land sells with planning.
Do you work with landowners in Winchester?
We do. We work with landowners in Winchester and elsewhere in Hampshire, including Farnborough, Gosport and Waterlooville. Send us a postcode and we will start with a free, no-obligation appraisal of what the land could take.
