Planning and land rules in Cambridge
Land with no planning permission can still be sold. Around Cambridge, the usual routes in England are a direct sale, an option agreement or a promotion agreement, where the planning work is funded for you and the land is sold once consent is granted. Outline planning permission settles the principle, with reserved matters approved later. Section 106 obligations, the Community Infrastructure Levy where charged and biodiversity net gain all affect what a site is worth, so independent advice matters.
In England, affordable housing on market developments in Cambridge is normally secured through a Section 106 agreement, which sets the number, tenure and transfer of homes to a registered provider. Grant from Homes England can add further homes, and the 2026 to 2036 programme expects at least 60% of funded homes to be Social Rent. Land to Homes can supply land, design and build homes, or deliver completed homes for councils and housing associations.
| Local planning document | Local Plan |
|---|---|
| Who decides applications | The local planning authority, usually the district, borough, city or unitary council (or a national park authority) |
| In-principle consent | Outline planning permission, with reserved matters approved later |
| Land transaction tax (paid by the buyer) | Stamp Duty Land Tax (SDLT) |
| How a sale becomes binding | A land sale becomes legally binding on exchange of contracts and finishes on completion, after which the buyer registers the title with HM Land Registry. |
Questions about Land and homes in Cambridge
Will I have to pay anything upfront?
Not on a promotion agreement. We fund the planning work, and those costs are only recovered from the sale proceeds if the land sells with planning permission. You will still need your own solicitor, but on option and promotion agreements we pay your reasonable legal fees, with the amount agreed in the heads of terms.
What kinds of land do you look at?
Fields and paddocks next to towns and villages, large gardens and backland, infill plots, brownfield and former commercial sites, farmland, and buildings that could convert to homes. Sites need realistic access and planning prospects. If land is too small or too constrained for us, we will say so plainly rather than leave you waiting for an answer.
Can you guarantee my land will get planning permission?
No one can guarantee planning permission. Decisions rest with the planning authority or, on appeal, an independent appeal body. What we can do is assess the prospects honestly, prepare a thorough application and deal with likely objections early. If we think a site is unlikely to succeed, we will tell you before anyone spends time or money on it.
What is a new-build warranty?
It is an insurance-backed policy covering certain defects in a new home for a set period after completion. The builder is usually responsible for most defects early in the cover, and the warranty provider covers major structural problems later. Most mortgage lenders expect a recognised warranty, or a professional consultant's certificate, before they lend on a new home.
Is Cambridge an area you cover for land?
Yes, we cover land in Cambridge and elsewhere in Cambridgeshire, including March, Ely and Peterborough. Where a site suits us we can buy it directly, or set up an option or promotion agreement. On promotion there is nothing to pay upfront.
