Rules that apply in Billingham
Whether a field or large garden could take homes depends mostly on the council's Local Plan and national policy. Under the National Planning Policy Framework, plans define settlement boundaries, and land just outside Billingham may still come forward if it is allocated, previously developed or meets evidenced unmet housing need. Smaller housing schemes can also use Permission in Principle, an England-only route that settles location, use and amount first. Our free appraisal explains which route suits your land.
Renting a new home in Billingham? In England, most private tenancies are now assured periodic tenancies with no fixed end date, and since 1 May 2026 landlords can no longer use section 21 no-fault evictions. New-build buyers usually receive a structural warranty and buy through exchange of contracts and completion, paying Stamp Duty Land Tax where it is due. Land to Homes has no homes for sale or rent yet, but you can register your interest.

| Who decides applications | The local planning authority, usually the district, borough, city or unitary council (or a national park authority) |

| Developer contributions | Section 106 planning obligations, plus the Community Infrastructure Levy (CIL) where the council charges it |
Land and homes in Billingham: questions
Do you have any new homes for sale or rent?
Not yet. Land to Homes is a new venture and has no homes, plots or developments for sale or rent at the moment. You can register interest with the area and type of home you want, and we will contact you if we bring forward homes that match. We do not take reservations, fees or deposits at this stage.
What is biodiversity net gain?
Biodiversity net gain is a requirement in England for most new developments to leave natural habitat in a measurably better state than before, assessed using a statutory metric. It can be delivered on site, off site or, as a last resort, through statutory credits. It affects how much land a scheme needs. Wales, Scotland and Northern Ireland have their own biodiversity policies.
Will I have to pay anything upfront?
Not on a promotion agreement. We fund the planning work, and those costs are only recovered from the sale proceeds if the land sells with planning permission. You will still need your own solicitor, but on option and promotion agreements we pay your reasonable legal fees, with the amount agreed in the heads of terms.
What is an option agreement?
An option agreement gives a developer the right, but not the obligation, to buy land within an agreed period, usually once planning permission is granted. The landowner normally receives an option fee, and the purchase price is worked out under an agreed formula. On option agreements with Land to Homes, we pay your reasonable legal fees, agreed up front in the heads of terms.
Is Billingham an area you cover for land?
Yes, we cover land in Billingham and elsewhere in County Durham, including Chester-le-Street, Bishop Auckland and Stockton-on-Tees. Where a site suits us we can buy it directly, or set up an option or promotion agreement. On promotion there is nothing to pay upfront.
