Sell Land Without Planning in Ayr

Can I sell land without planning in Ayr?

Selling a site in Ayr before planning comes down to who carries the risk and the cost of the application. Land to Homes looks at local planning policy, access and constraints, then sets out which deal fits: a direct purchase, subject to survey, title and contract, a conditional contract, or a longer-term option or promotion.

Ayr sits about 12 miles south-west of Kilmarnock in Ayrshire, in the KA7 postcode district. The nearest other places we cover are Irvine (11 miles), Kilmarnock (12 miles) and Newton Mearns (24 miles).

In and around Ayr, the land we appraise ranges from corner plots and side gardens to redundant commercial buildings, including fields put forward or allocated in the local plan. As Ayr is in Scotland, applications are judged against National Planning Framework 4, and the buyer of land pays Land and Buildings Transaction Tax (LBTT).

Tell us where your land is around Ayr and we will explain the routes open to you.

What you get in Ayr

Option or promotion routes

Where planning will take longer, an option or promotion agreement lets us fund the application while you keep ownership. We explain the difference, including who benefits from a higher or lower sale price.

Constraints checked first

Flood risk, access, heritage, ecology, protected trees and landscape designations can each decide whether planning is realistic. We look at all of these before discussing any deal or price mechanism with you.

Buying land as it stands

Where we can see a planning route we are prepared to back, we can buy your land as it stands, with no onward chain, subject to survey, title and contract.

Overage protects the upside

If you sell now, an overage clause can entitle you to a further payment if a more valuable permission is granted later. We explain how triggers, duration and security are usually set out.

Rules that apply in Ayr

Scottish land deals differ from the rest of the UK in a few ways: contracts are concluded by missives, consent in principle is called planning permission in principle, and developer contributions use Section 75 agreements. Land to Homes works within those rules around Ayr, whether buying a suitable site directly with no onward chain, subject to survey, title and contract, or promoting it through planning with nothing to pay upfront. Planning permission is never guaranteed, so we explain the risks plainly.

In Scotland, the Local Development Plan and National Planning Framework 4 decide where housing goes. Land is often sold on missives with a suspensive condition that planning permission in principle is granted. Under the newer plan system councils prepare an evidence report before the proposed plan, so landowners benefit from engaging early.

Your questions answered for Ayr

Can I keep using the land while planning is pursued?

Usually, yes. Under options and promotion agreements you normally keep ownership and can carry on using the land, for example for grazing or farming, until it is sold. The agreement sets out access for surveys and any restrictions, such as on granting new long-term tenancies.

What is a subject to planning contract?

It is a contract where both sides commit now, but the sale only completes if a satisfactory planning permission is granted. It sets a longstop date, defines what counts as satisfactory and usually says who controls the application. If permission is not granted by the longstop date, either side can normally withdraw without penalty.

What is a call for sites?

When a council prepares or reviews its development plan, it usually invites landowners and developers to put land forward for consideration. Submitting your site does not mean it will be allocated, but it puts the land in front of the council's planning team. In Wales this is usually called the candidate site process.

What if my land has been refused planning before?

A previous refusal is useful evidence, not necessarily the end of the story. Policy changes, new local plans and a different scheme can lead to a different outcome. We read the refusal reasons and any appeal decision before giving a view on whether a fresh approach is realistic and worth the cost.

Do you buy land in Ayr?

Yes. Land to Homes looks at land in Ayr and elsewhere in Ayrshire, including Irvine and Kilmarnock. Every enquiry starts with a free site appraisal, and on option and promotion agreements we pay your reasonable legal fees.
