Sell Land with Planning Permission in Lincoln

Can I sell land with planning permission in Lincoln?

Before you sell a consented site in Lincoln, check when the permission expires and which conditions must be cleared before work can start. Those two points shape what a builder will pay. Our free, no-obligation appraisal looks at the permission itself, then explains whether a direct purchase or an open-market sale suits you better.

Our approach in Lincoln

Conditions priced in

Pre-commencement conditions, such as drainage, materials or ecology details, must be discharged before work starts. We identify which are outstanding, what they are likely to cost and who would deal with them.

Permission read in full

We read the decision notice, the approved plans and every condition, so any offer reflects what the consent actually allows rather than the headline number of homes on the application form.

Expiry dates checked

Most permissions lapse if development does not lawfully begin within the period set in the decision. We check the deadline, and whether a lawful start has already been made, before discussing any deal.

Direct purchase of consented sites

Where a consented site suits us, we can buy it ourselves with no onward chain, subject to survey, title and contract. Any planning agreement passes to us with the land.

Planning and land rules in Lincoln

Whether a field or large garden could take homes depends mostly on the council's Local Plan and national policy. Under the National Planning Policy Framework, plans define settlement boundaries, and land just outside Lincoln may still come forward if it is allocated, previously developed or meets evidenced unmet housing need. Smaller housing schemes can also use Permission in Principle, an England-only route that settles location, use and amount first. Our free appraisal explains which route suits your land.

In England, buyers check Section 106 obligations, any Community Infrastructure Levy liability and, for many newer permissions, the biodiversity gain condition, which usually requires a biodiversity gain plan to be approved before work starts. We also confirm whether the consent came from a full application, an outline approval, or Permission in Principle followed by technical details consent.

Your questions answered for Lincoln

Does planning permission go with the land when I sell?

Yes. In most cases planning permission runs with the land, not the owner, so it passes to the buyer automatically. Personal permissions are rare exceptions. Planning agreements tied to the consent, such as a Section 106 agreement in England and Wales, also bind the land, so the buyer takes on those obligations as well.

Is outline planning permission worth less than full permission?

Usually, because more approvals are still needed. Outline permission sets the principle and sometimes the access, while reserved matters such as layout, scale, appearance and landscaping come later. A buyer allows for the cost and risk of that remaining work. In Scotland the closest equivalent is planning permission in principle.

What checks will a buyer make on land with planning permission?

Expect checks on the decision notice and conditions, any planning agreement, the title and boundaries, access and visibility at the junction, drainage and utility connections, ground conditions, ecology and flood risk. A surprise found late can lead to renegotiation, so sharing what you already know early tends to keep a sale on track.

What happens if my planning permission is about to expire?

If development has not lawfully begun by the deadline, the permission usually lapses and a new application is needed, which may be judged against newer policy. The usual choices are to sell to a buyer able to make a lawful start, to apply again, or to make a start yourself after discharging pre-commencement conditions. Take planning advice early.
