The Scottish system, as it applies in Hawick
Land sales in Scotland are concluded through missives, an exchange of formal letters between solicitors. Once missives are concluded they form a binding contract, and the buyer takes entry at settlement, then registers the title with Registers of Scotland. For land near Hawick, missives can be made conditional on planning permission in principle, so the sale only proceeds if consent is secured. The buyer pays Land and Buildings Transaction Tax to Revenue Scotland.
Scotland's Affordable Housing Supply Programme has a national target for new affordable homes, most of them for social rent. Councils and registered social landlords around Hawick deliver most of these, mainly as new build, with registered social landlords regulated by the Scottish Housing Regulator. Land to Homes can supply sites, design and construction to help partners deliver, whether on land we bring forward or land a partner already owns.

| How a sale becomes binding | Land sales are concluded through missives, formal letters exchanged between solicitors that become a binding contract once concluded, followed by settlement on the date of entry and registration in the Land Register of Scotland. |

Your questions answered for Hawick
Can you guarantee my land will get planning permission?
No one can guarantee planning permission. Decisions rest with the planning authority or, on appeal, an independent appeal body. What we can do is assess the prospects honestly, prepare a thorough application and deal with likely objections early. If we think a site is unlikely to succeed, we will tell you before anyone spends time or money on it.
Do you have any new homes for sale or rent?
Not yet. Land to Homes is a new venture and has no homes, plots or developments for sale or rent at the moment. You can register interest with the area and type of home you want, and we will contact you if we bring forward homes that match. We do not take reservations, fees or deposits at this stage.
What kinds of land do you look at?
Fields and paddocks next to towns and villages, large gardens and backland, infill plots, brownfield and former commercial sites, farmland, and buildings that could convert to homes. Sites need realistic access and planning prospects. If land is too small or too constrained for us, we will say so plainly rather than leave you waiting for an answer.
Will I have to pay anything upfront?
Not on a promotion agreement. We fund the planning work, and those costs are only recovered from the sale proceeds if the land sells with planning permission. You will still need your own solicitor, but on option and promotion agreements we pay your reasonable legal fees, with the amount agreed in the heads of terms.
Is Hawick an area you cover for land?
Yes, we cover land in Hawick and elsewhere in Scottish Borders, including Peebles, Kelso and Galashiels. Where a site suits us we can buy it directly, or set up an option or promotion agreement. On promotion there is nothing to pay upfront.
