Planning and land rules in Angus & Dundee

Land sales in Scotland are concluded through missives, an exchange of formal letters between solicitors. Once missives are concluded they form a binding contract, and the buyer takes entry at settlement, then registers the title with Registers of Scotland. For land near Angus & Dundee, missives can be made conditional on planning permission in principle, so the sale only proceeds if consent is secured. The buyer pays Land and Buildings Transaction Tax to Revenue Scotland.

Scotland's Affordable Housing Supply Programme has a national target for new affordable homes, most of them for social rent. Councils and registered social landlords around Angus & Dundee deliver most of these, mainly as new build, with registered social landlords regulated by the Scottish Housing Regulator. Land to Homes can supply sites, design and construction to help partners deliver, whether on land we bring forward or land a partner already owns.

Common questions in Angus & Dundee

What is planning permission?

Planning permission is consent from the planning authority to carry out development, such as building new homes or changing the use of land. Applications are judged against the local development plan and national policy, which differ in England, Wales, Scotland and Northern Ireland. Permission can be full, or outline, which is called planning permission in principle in Scotland.

What is a local development plan and why does it matter?

The development plan sets out where new homes and other development should go, and it is the starting point for planning decisions. In England it is usually called the Local Plan; Wales, Scotland and Northern Ireland have Local Development Plans. Land allocated for housing, or next to a settlement where policy supports growth, usually has stronger prospects.

Can you guarantee my land will get planning permission?

No one can guarantee planning permission. Decisions rest with the planning authority or, on appeal, an independent appeal body. What we can do is assess the prospects honestly, prepare a thorough application and deal with likely objections early. If we think a site is unlikely to succeed, we will tell you before anyone spends time or money on it.

What is an option agreement?

An option agreement gives a developer the right, but not the obligation, to buy land within an agreed period, usually once planning permission is granted. The landowner normally receives an option fee, and the purchase price is worked out under an agreed formula. On option agreements with Land to Homes, we pay your reasonable legal fees, agreed up front in the heads of terms.

Is Angus & Dundee an area you cover for land?
